PGL Corporation assumes no liability and bears no liability for any use, misuse or failure to perform. All products are sold “as is” and “with all faults.” No warranties of fitness, or use are provided. The entire risk of use, quality and performance of all products remains solely with the consumer. Ballistic, edged and spike resistance ratings are limited to the conditions under which laboratory testing was conducted, including but not limited to, barrel length, shot distance, shot placement, temperature, powder, velocity, bullet mass, bullet composition, backing material etc.

BY PURCHASING PRODUCTS FROM PGL CORPORATION YOU AGREE TO BE BOUND BY THE FOLLOWING TERMS AND CONDITIONS (“TERMS”).

You hereby represent, warrant, agree, and confirm that you:

4. Are not legally barred from purchasing, possessing, or using the item(s) purchased;

11. Understand that body armor is bullet resistant and no body armor is guaranteed to stop 100% of ballistic or other threats. Any time a bullet or projectile is fired at you, whether you are wearing armor or not, you are at risk of injury or death;
12. Agree for yourself and your heirs, assigns, and agents to fully and completely release PGL Corporation from all liability; to never bring an action against PGL Corporation in a court of law; and to indemnify, defend, and hold harmless PGL Corporation for any and all liability arising from your purchase, possession, use, or misuse of products sold.

Liability Disclaimer

PGL Corporation assumes no liability for the use or misuse of any product sold, donated, or loaned, including but not limited to any incidental or consequential liability or damages.
Except where a manufacturer’s warranty applies, all warranties, including implied warranties of fitness and merchantability, are expressly disclaimed.

Statements, images, or descriptions of products are for informational purposes only and do not constitute a warranty. PGL Corporation’s liability is limited strictly to repair or replacement of defective items.

Export Control Compliance

Certain armor products, such as Level III Rifle Rated Plates, are subject to the U.S. Department of Commerce’s Bureau of Industry and Security (BIS) and the Export Administration Regulations (EAR).
Export or retransfer of such products requires written approval from the U.S. Department of Commerce.
Violations may result in civil and/or criminal penalties.

PGL Corporation complies fully with U.S. export control laws and will not assist, directly or indirectly, in the illegal export or re-export of any product.
The customer is responsible for complying with all applicable import/export laws, duties, and taxes.

Jurisdiction and Venue

These Terms are governed by and construed in accordance with the laws of the United States and the State of Delaware, without regard to conflict of law principles.
You agree that any dispute shall be brought exclusively in a state or federal court located in New Castle County, Delaware.

If any provision of these Terms is held invalid by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect.

PGL Corporation reserves the right to revise these Terms at any time without prior notice.
